SPOUSES/COMMON-LAW PARTNERS OF SKILLED WORKERS

A spouse/common-law partner who is dependent on the principal foreign worker, is eligible to apply for an open work permit. The principal foreign worker must:-

  • hold a work permit that is valid for a period of at least 6 months;
  • be employed in an occupation that falls within National Occupational Classification (NOC) skill type 0 or skill levels A or B;
  • physically reside or plans to physically reside in Canada while working.

SPOUSES/COMMON-LAW PARTNERS OF POST GRADUATE WORK PERMIT HOLDERS

A spouse/common-law partner of the primary foreign worker with an open work permit(e.g. post-graduation work permit, working holiday work permit, etc.) can also apply for an open work permit and will need to submit:-

  • a letter from the principal foreign worker’s current employer confirming their employment; and
  • a copy of the principal foreign worker’s last 3 pay slips

SPOUSES OR COMMON-LAW PARTNERS OF FULL-TIME STUDENTS 

A spouse/common-law partner of foreign students are allowed to accept employment in the general labour market without the need for an LMIA. The work permit issued will have validity date that coincides with the spouse’s study permit. Applicants must prove that his/her spouse is a full time student at a designated learning institute in Canada.
